April 19, 2013 - Is Tax Court Afraid to Rule on This?

I've been to Canada's Tax Court twice, seeking justice. They have both times and by different means, avoided ruling on my position. I believe that this court, controlled by legislation as it is, and its judges are complicit in massive fraud and in defrauding the people of Canada.

My position is that:

  1. I have waived my right to be considered a "person" before the law in matters of the Income Tax Act, and that; 
  2. being that Canada is a corporation, I, as a man, cannot be resident therein.

These two points are important since the Income Tax Act, in section 2(1), states:

An income tax shall be paid, as required by this Act, on the taxable income for each taxation year of every person resident in Canada at any time in the year.

The judges are either ignorant of human rights and the rule of Law or they are criminally involved in plundering the people who live on the geographical land mass called Canada because the Law is clear if they read it rather than assume they know it.

The Constitution Act of 1867, also referred to as the supreme law of Canada states, in section 4, that:

Unless it is otherwise expressed or implied, the Name Canada shall be taken to mean Canada as constituted under this Act.

 Used in any legal document, the name "Canada" shall be take to refer to a constituted corporation, not the land mass that we know it as out here on the streets.

A man or a woman—human-beings—cannot reside in a corporation, a legal entity such as "person" can.

The Interpretation Act defines "person" as:

“person”, or any word or expression descriptive of a person, includes a corporation (read the link to "includes")

Every time the term "person" is used in statute law or in legislature it is a legal entity to which it refers, not to a man or woman. A legal entity—a person—is created by an act of legislature, statutes law.

The International Covenant of Civil and Political Rights states in article 16:

Everyone shall have the right to recognition everywhere as a person before the law.

This is proof positive that personhood is a right granted, not automatic and not a state into which we are naturally born. As a right it is also a state that we can waive or choose not to "enjoy."

All statute law deals with the "person," not with a man or woman. Read any Act of Parliament, which is statute law, for yourself and see that it only refers to "persons."

No man or woman is obligated to obey statute law unless they close to do so.

The Income Tax Act does not apply to a man or woman unless you want it to. By volunteering to fill in their forms you indication that you want to participate.
